Abstract

This paper reviews an important aspect of dealing with the governance or similar thoughts in the modern theories of state and governing system. The importance of the current paper is derived from the fact that the positions of the Imami jurists are based on their theoretical and practical answers on sharia evidence that were rooted in their day to day dealings with different topics and issues. Such answers are subjected to jurisprudence and deductions that possibly do not agree with each other's. However, the pattern of dealing with such topics at any level reveals that the meaning of the problem about the existence of evidence that relies on it. This opens up an important opportunity for the researcher to look into these legislations and the evidence in an attempt to adapt the different patterns of dealing in This term or that which falls in the concept of the state in general.
