Abstract

What we dealt with in this research is the narration of the dialectical aspects that are hidden in one of the evidences of the principles of jurisprudence, which is the evidence of consensus. The lack of agreement on its meaning and the absence of real endorsements for it among the schools of jurisprudence, except for some of its meanings. It is intended from the controversy and doubts that revolve around him. We have paved the way for the research by addressing the cases of use and application of consensus, which is the absence of the legal text, so the consensus is seen as one of the treatments for lack of legal text, then we referred to the areas of controversy in it, and we ended up confirming its dialectic that does not seem to have a cure.
