A Critical Analysis of the Requirement of Acceptance in Waqf with Reference to Its Nature in Imami Jurisprudence

Although the requirement of acceptance for all types of endowments has been adopted by some Imami jurists, this group of jurists has relied on various arguments to support their view, including: the necessity of the consent of the beneficiary; the invalidity of the endowment upon the return of the beneficiaries; its being a property; its being a two-party contract; its being a contract; its adherence to the principle of corruption in transactions; and its claim of consensus on this view.
However, many Imami jurists have disagreed with this view, and these are divided into two groups: one group, which specifically argued that acceptance in a general endowment is not binding; and another group, which denied the requirement of acceptance in all types of endowments.
The present study, using a descriptive-analytical approach, examines the foundations of these views. Its findings conclude that the evidence for the theory of stipulation faces substantial criticism, while the evidence against stipulation—such as the validity of a waqf in common usage as a waqf without acceptance, the absence of acceptance restrictions in narrations, Islamic practice, and other evidence—is more valid and convincing. Therefore, this view is defensible.
