Response (Arred walawal) in Inheritance

A Comparative Jurisprudential Study

Abstract

The topic of (Arred walawal) is an important topic in inheritance law. Those who do not know them know nothing. Therefore, I decided to research this topic, explaining the meaning of (Arred wa Alawal), and the views of Muslim jurists on them. In the first section، we discussed the topic of refusal, clarifying the meaning of refusal linguistically and technically، and the positions of jurists on it. Some permitted it, while others did not. Those who advocated its permissibility also differed on who the proponents of refusal were. All of this was explained in the first section، favoring the valuable opinion that, in our belief, should be adopted.

The following section was devoted to explaining (Alawal) linguistically and technically. We then identified the first proponents of it, explaining the scholars' views on it, then discussing the evidence and weighing what we believe to be the most valid، based on the strength of the evidence.
