Legal cover for popular mobilization in the Constitution and international humanitarian law

Abstract

This research aims to study the legal cover of popular mobilization in the Constitution and international humanitarian law under the circumstances facing Iraq.
The study included three basic topics: the first topic dealt with the legal organization of the popular mobilization. While the second topic dealt with the laws of compulsory recruitment and the National Guard and the institution of martyrs and popular mobilization, while the third topic dealt with legal support for popular mobilization under international humanitarian law.
This study has reached a number of results, the most important of which is: "The enactment of a law that protects the grassroots factions will preserve the rights of all, including the rights of tribesmen who have joined the popular mobilization." The law should protect the rights of residents in the event of abuse and violation by volunteers of the popular crowd. "
The study also reached a number of proposals, the most important of which was the following: Emphasizing the need to amend the constitution or to write a new constitution compatible with each other, so as to require the interests of the Iraqi people in all its components, not to the interests of parties, families and influential personalities
