Abstract

The Penal Code, in its substantive and procedural sections, guarantees the necessary safeguards for the protection of human rights and freedoms. It aims at protecting the public and private interests and is concerned with providing different guarantees to individuals at all stages of the criminal case, including the right of criminal appeal, which may become a means of delaying the resolution of the case and prolonging the case. If the litigants in the criminal case intentionally exploited, abused or abused this guarantee with a view to deviating it to other purposes that harm others or to obtain unlawful interests, which makes them a cause of suffering, which disturbs the administration of justice and leads to the loss of justice. Public confidence in the smooth functioning of justice.
