The Objective Effects of The Crime of Insulting The Emblem of the State in Iraqi and Comparative Legislation
Abstract
The national emblem is a symbol of the sovereignty of the state, Its national dignity, Evidence of its existence and independence, And its participation in international forums. Therefore, It requires that it enjoy the respect and appreciation due to every person in every time and place, And given the sacred moral and symbolic value that the emblem carries, The legislation has given its attention By protecting the national emblem from insulting behaviour, As it criminalized every saying, Action, Sign or writing that carries with it a detraction from the dignity and respect of the emblem, And due to the seriousness of this behavior and the moral assault it carries on the dignity and dignity of the state, The Iraqi legislator has criminalized this behavior in Article (202) of the Penal Code in force No. (111) of 1969 and Article (2/10) of the amended Emblem of the Republic of Iraq Law No. 2 of 2023 .
