Provisions for the marriage of a minor,

Abstract

Since a minor's marriage is a marriage contract of which one of the parties is a non-adult and, since it is customary in our societies that a minor's marriage means a marriage in which the wife is a minor, Since the marriage of minors is one of the manifestations that constitutes a catastrophe for society due to the negative effects of both the end of most of these marriages with children and mothers unable to raise them properly or the physical and psychological harm suffered by minors in such cases, In view of the widespread controversy in this matter and the fact that there are many differences in the provisions of the marriage of minors between the Islamic religion and the law adopted in Iraq, these differences must be identified and elaborated both on the terms of the minor's marriage

and on the elements of the marriage contract and on the barriers to such marriage. In the first examination, we will examine the elements of the marriage contract between Islamic jurisprudence and Iraqi law. We will also review the differences and compatibility between Islamic jurisprudence and Iraqi law on the issue of the marriage of minors.
