Abstract

The main focus of this research delves into the concept of qisas as it relates to Islamic law and the criminal law system in Iraq. We aimed to ascertain whether there were any similarities or differences between death sentences in Islamic law and Iraqi criminal law, highlighting whether or not there were common principles. To gain a comprehensive understanding of criminal law, particularly with regard to the death penalty, a close examination of the Iraqi Penal Code is necessary. In this analysis, we will explore the individual sentences and processes that determine the requirements for the execution of the death penalty. The use of the death penalty in Iraq, as dictated by Iraqi Sharia law, remains a matter of contention, particularly with regard to individuals found guilty of criminal offences
