Legality of the controlling company - a comparative study

Abstract

The beginning of the second half of the twentieth century witnessed the beginning of a new phase in the development of the capitalist system, characterized by what we might call "international production." The production process within the capitalist enterprise began to take place at the international level, such that the global economy gradually replaced the various national or local economies. The tool and means of this transformation were the dominant companies, which emerged at the end of the nineteenth century in the United States of America, and from there spread to Europe, which opened a new phase of capitalist concentration, such that the stages of the production process within a single enterprise were distributed across various countries of the world, while continuing to be subject to central control by the companies under study. This phenomenon became an attempt to root it, and to search for legal formulas that are compatible with its nature and encompass its activity.
