Abstract

Abstract: There is no doubt that penal procedures in any legal system and in other legislations of countries are subject to development, and this development that we are talking about may resort to the competent authority to issue the penal text for the necessity of what it appreciates when developing a text, or that the political situation in the state forces those in charge of the advanced job to develop these procedures, The major transformations for the creation of penal procedures begin with the independence of the judiciary itself. The independence of this authority is the first key to the integrity of the creation and the seriousness of its existence. Keeping pace with the new transformations necessitated the existence of such procedures, and our discussion of this revolves within the framework of analyzing the texts that dealt with such innovative penal procedures.
