Constitutional protection of freedom of worship in the 2005 Iraqi Constitution
Abstract
: Freedom of worship is considered one of the most important human rights because it is linked to his thought and conscience. It is one of the basic freedoms because it relates to the spiritual and moral side of the human being. The measure of any democratic society is the extent to which its members enjoy their rights and freedoms, foremost of which is the freedom of worship and religious belief. International declarations and conventions have played an important role in protecting and respecting freedom of worship. Worship by giving it the highest status in international agreements and the efforts made by international organizations to move it from the national sphere to the international sphere, in order to achieve the principle of equality for all individuals without discrimination due to religion, affiliation or gender. It is noted that freedom of worship has two basic, interrelated aspects. The first is a moral aspect, which is The freedom of the religious individual to believe or not to believe in any religious belief. As for the second aspect, it is
a material aspect and is represented by the freedom of the individual to express his religious belief, which represents the freedom to worship in all forms of legitimate expression, and to practice the rites and rituals imposed on him through the belief that he adheres to, and the Constitution came The Republic of Iraq of 2005 to protect and guarantee freedom of worship by stipulating and protecting it in the constitution, as it is at the top of the constitutional pyramid, and that violating a constitutional text entails consequences.
