The principle of judicial security and the manifestations of its violation (an analytical study on the request for interpretation of judicial rulings and their sudden reversal)
Abstract
The principle of judicial security is one of the modern and flexible terminology in the world of law, and the specialists did not unite in defining its concept, and two directions emerged: the first is broad and includes all concepts that reflect confidence in the judicial institution, by providing all rights to the litigants from the time of the start of the case until the completion of its implementation, and the second A narrowness that is limited to the rulings issued by the supreme courts in the state, unifying the judicial principles issued by these courts, and working to create a judicial unity in its orientations judicial security reflects confidence in the judiciary and it performs its tasks in providing reassurance that the judgments it issues will be an example of justice and equality, because the ordinary judge in general and the administrative judge in particular plays an important role in completing the deficiencies that afflict the legal texts. With
this active role, the security of individuals is endangered and leads to a loss of trust .On this basis, depriving one of the litigants from submitting a request for interpretation of the judicial ruling during its implementation phase, and the sudden shift in the relatively stable principles of the judiciary, undoubtedly leads to a violation of the principle of judicial security, and in no case can these harmful effects be avoided except after providing sufficient guarantees. For litigants, it is represented in achieving equality between the parties to the lawsuit themselves, or between them and building similar lawsuits that have been settled by the judiciary.
