The moral pillar of the crime of electronic publishing of pornographic materials (a comparative study)
Abstract
The crime is (every act or omission that the legislator forbids) and therefore it is not possible to count what is in the mind of the offender or his psychological potential, as his criminal will must be directed with his knowledge of what he is doing, as well as that he wants the result, which is (criminal sin) or responsibility Criminal, which is the psychological link between each of the behavior and the result, which is (criminal intent). But if the offender does not want the behavior or the result when he performs a behavior, whether it is against the law or not taking the necessary precaution, but in an unintentional way, then we are facing a situation (mistake). Therefore, we
focus in this research on an important part of the study (electronic publication of pornography, a comparative study), It is the moral pillar of the crime by reviewing its most important elements (criminal intent and error). It is what gives the judiciary the imposition of punishment on it, and the perpetrators do not escape from punishment, and on the other hand, its guarantee is important in not arbitrarily imposing punishment on those who do not deserve it. And that the criminal legislator does not punish the mere thought of the crime. And the exact opposite of the material corner, which is visible to the outside world. And the crime under study in which the criminal consequence is its violation of moral and religious values and principles after the offender publishes indecent content, whether the offender intended his criminal behavior or as a result of not taking precaution while dealing with such content. There is no importance or lesson in the victim's consent, as it is a crime of danger, not harm, and therefore the result is achieved as soon as the offender places sexual content in front of the public.Hence the importance of the research for the study (criminal protection from the crime of electronic publishing of pornographic materials) as it is part of and complementary to the master's thesis.
