Abstract

Jurists and legal experts considered minors to be one of the necessities of confinement, and it is forbidden to dispose of them. Quarantine, in legal terminology, means incapacity to perform, and on the part of the boy, he is forbidden from actions. The jurists relied on the evidence of the Qur’an, but they expressed exceptions and said: The minor is interdicted by the text and consensus. If he is discerning or not in all behaviors except in cases of exceptions, the question is: What is the rule of the law regarding the exceptions that prevent a boy from acting? Is it possible to extend to other topics or not? Within the discussion of jurisprudential texts and the study of civil laws, the researcher believes that the condition in the necessary provisions is puberty, and the resources are exceptions that are not related to the necessary provisions, but are related to the statutory and mandatory provisions that are not necessary.
