Legal analysis in controlling the leadership authority in the constitution of the Islamic Republic of Iran

Abstract

The issue of control and oversight of the authority of leadership is of great importance in terms of constitutional rights. Article 111 of the Constitution does not explicitly mention anything related to the supervision of the leadership, but part of this principle says: When the leader is unable to perform his legal duties or does not have one of the conditions mentioned in Principle 5 and 109 or it turns out that the leader lacks some Conditions from the outset, he will be removed from his post, and according to Article 108, determining this matter rests with the experts. Undoubtedly, this diagnosis in the aforementioned principle requires an introduction, of which monitoring is one. The application of Article 8 of the Constitution also reflects the popular supervision of the leader. Article 142 of the Constitution deals with the stewardship of a leader's property. According to Article 107 of the Constitution, the leader is equal to the rest of the country before the law. In the end, all cases of oversight leading to the removal of the leader are the responsibility of the Assembly of Experts. Expert supervision type of leadership, is reasonable supervision. The main focus of the article is to clarify the issue of control or supervision of leadership in the constitution.
