Abstract

One of the general rules established in modern criminal legislation is that it does not ask a criminal other than a human being. This is because the acts that are prohibited by the provisions of these legislations are supposed to be issued by the person and the penalties prescribed for them can not be imagined to descend without man. The criminal penalty (punishment and precautionary measure) represents the social reaction against those who determine their criminal responsibility for committing a crime against the environment, considering that the occurrence of the crime involves a threat to security and stability of society and a fundamental interest to protect it. And precautionary measure in addressing environmental crime.
