Abandonment of nationality acquired for holders of sovereign positions in accordance with the Constitution of the Republic of Iraq for the year 2005
Abstract
The issue of dual citizenship raises many different problems in relation to the different reactions in the circles of Iraqi political life, in addition to the different opinions of those interested in this aspect. What the constitutional texts and the Iraqi Nationality Law have provided regarding the issue of dual citizenship has represented a shift in the scope of the orientations of the Iraqi legislator, who dealt with a sensitive and important issue, as it is linked to the sovereignty of the state. The state of duality is an idea related to citizenship, as it represents a serious and unacceptable violation of sovereignty, and it also contributes to breaching the immunity provided by the idea of sovereignty in the field of the state’s freedom in matters of national security. Therefore, the aforementioned issue can be raised on more than one level. There is a legal dimension to the issue, in addition to the political dimension. What we will try to examine is only the legal dimension, avoiding the political aspect, as it is not our business, although we acknowledge from the outset that the law, whether it is related to the texts stipulated in the constitution or the legal rules resulting from ordinary legislation, is nothing but documents of victory for political forces at the expense of other political forces. The truth is that it represents a reality that is difficult to ignore, as whoever possesses real power in any human society Whether ancient or modern, they are the individuals who have real interests in it and feel that their existence and survival are linked to the society in which they live. As for those who look out the window at other societies and feel a sense of belonging to them, they cannot achieve anything in society.
