The aim of the research to identify the legal nature of the criminal protection of freedom of expression, and the importance of research in criminal protection and the legal nature of the freedom of change of opinion, through the Iraqi laws that provided for the protection of the right to expression of opinion, as well as the Constitution of the Republic of Iraq for the year 2005, as well as the importance of studying the subject to increase libraries sources and references, which dealt with the legal nature of penal protection, The problem of the research lies in the following question: What is the legal nature of the penal protection of freedom of expression? For the purpose of reaching the desired results of the research, the researcher used the descriptive analytical approach and in some cases the comparative approach to know the results.
