The legal nature of the dissolution of private higher education institutions (a comparative study)

The administration, in exercising its activities, enjoys certain privileges as a person of public law. It has the authority to issue administrative decisions, but the legislature may impose specific forms and procedures on the administration when issuing certain decisions. Thus, the administration has no choice but to follow the path laid out by the legislation. The decision to dissolve private higher education institutions is one of the most significant decisions issued by the administration, based on the request of the designated entity specified by the legislation. The importance of the dissolution decision lies in its impact on the legal personality, as it terminates the legal personality of private higher education institutions. These institutions are among the key supporters of governmental higher education in managing higher education facilities. Therefore, legislation designates the competent authority to issue this decision and sets the necessary conditions for the administration to issue it in accordance with the principle of legality, thereby safeguarding individuals' rights and serving the public interest.
