علاقة المحكمة الجنائية الدولية بمجلس الأمن وآليات النفاذ الوطني لجريمة العدوان طبقا لتعديلات مؤتمر كمبالا

في تاريخ 12 حزيران /يونيو 2010 عقد المؤتمر الإستعراضي الأول للمحكمة الجنائية الدولية في كمبالا عاصمة اوغندا الذي نتج عنه اصدار قرار اعتمد بتوافق الاراء , يعرف جريمة العدوان ويضع القواعد الاساسية لممارسة المحكمة لاختصاصها بالنظر في الجريمة , وقد جاء هذا القرار بعد عشرات السنين من الجهود والمفاوضات المبذولة لغرض وضع تعريف لجريمة العدوان , وستدخل التعديلات حيز النفاذ على اقرب تقدير في عام 2017 بعد مصادقة ما لايقل عن ثلاثين دولة وصدور قرار من قبل جمعية الدول الاطراف بتوافق الاراء او بأغلبية الثلثين لاعتماد التعديلات , ليصبح للمحكمة الجنائية الدولية اختصاص اصيل بالنظر في جريمة العدوان لأول مرة منذ محاكمات نورمبيرغ وطوكيو بعد الحرب العالمية الثانية .
إلا انه لا تزال هنالك بعض المشاكل العالقة المتمثلة بطبيعة دور مجلس الأمن بموجب التعديلات المتعلقة بجريمة العدوان , وهل ان المحكمة ستتمتع فعلا بالاستقلالية عند ممارسة اختصاصها على جريمة العدوان ام ان دور مجلس الأمن قد يحول دون ذلك , كما ان التعديلات قد ابقت على نظام التكامل منطبقا على جريمة العدوان مما سيؤدي الى عرقلة ممارسة المحكمة لاختصاصها على الجريمة مستقبلا.
On the date of June 12, 2010 Review Conference first International Criminal Court in Kampala, capital of Uganda, which resulted in the issuance of a resolution adopted by consensus, defining the crime of aggression and the basic rules for the exercise of the court's jurisdiction to consider the crime, The decision came after decades of efforts and negotiations undertaken for the purpose of a definition of the crime of aggression, and will enter into force of amendments at the earliest in 2017 after approval by at least thirty countries and a decision by the Assembly of States Parties by consensus or a two-thirds majority for the adoption of the amendments, to become the International Criminal Court jurisdiction of a genuine consideration of the crime aggression for the first time since the Nuremberg and Tokyo after World War II.
But he still there are some outstanding problems of the nature of the role of the Security Council under the amendments on the crime of aggression, and whether the court actually enjoy autonomy in the exercise of its jurisdiction over the crime of aggression or is it that the role of the UN Security Council could prevent it, as the amendments have kept the system integration applicable on the crime of aggression, which will lead to the obstruction of the exercise of the Court's jurisdiction over the crime in the future.
