دور رئيس الدولة في اختيار رئيس مجلس الوزراء وانهاء ولايته في الدستور اللبناني النافذ - دراسة تحليلية

إن النظام البرلماني يشترط أن يكون رئيس مجلس الوزراء ممثلا لأغلبية داخل البرلمان المنتخب من الشعب, حيث لا يملك رئيس الدولة سلطات كاملة في اختياره وإنهاء ولايته, فيجب عليه أن يرسل لرئيس الحزب الأكبر ويدعوه ليشكل الحكومة فلا اختيار لرئيس الدولة امام حزب حاز أغلبية واضحة مع التعرف على قائده, بل عليه ان يستدعي زعيم الحزب ليشكل الحكومة، كما ان البرلمان هو صاحب الحق في إنهاء ولايته وليس رئيس الدولة.
وقد تبنت لبنان النظام البرلماني وحاول المشرع الدستوري جاهدا تبني قواعد هذا النظام بأصولها الأساسية لكن الاعتبارات السياسية والمذهبية والقومية انعكست على واقع النص الدستوري فيما يتعلق باختيار رئيس مجلس الوزراء وإنهاء ولايته في ظل الدستور اللبناني.
The parliamentary system is required to be president of the Council of Ministers , representing the majority in the parliament elected by the people , which does not have a head of state full powers to choose anyone he wants , he must be sent to the head of the largest party and invites him to form a government do not choose the head of state before the party won a clear majority with identification the captain , but it requires that the party leader to form a government .
has adopted a parliamentary system and constitutional legislator tried hard to adopt the rules of the system , but its origins basic considerations of political , sectarian and nationalist reflected on the reality of the constitutional provision regarding the selection of the Prime Minister in lbnan under the 1926 Constitution .
