الدولة في المنظور الفقهي

Abstract

اعتمد البحث على دراسة الدولة ضمن المنظومة المعرفية الإسلامية، مع تحديد البحث في إطاره الفقهي والديني، من دون التعرض للمنظومة الفلسفية أو الاجتماعية، ومن دون أن يأخذ على عاتقه تبني فقها ما للدولة؛ لعدم اتضاح الرؤية فيه، لاسيما في المقاربات المعاصرة للدولة المدنية وتنظيماتها واصطدامها بحق المعصوم في الفقه الأمامي وحق الحاكم المستبد في الفقه السني، الا انه عرض لمفهوم الدولة مفهوما ومصطلحا، ولشرائط الدولة في ظل الدعوة المحمدية، ثم عالج اشكال نظام الحكم في ظل الخلافة وفيما بعده ضمن الاطر النظرية التي تمحض فيها الفقه السني والفقه الامامي.
