اختصاص البرلمان في المساءلة الجزائية نشأة وتطورا

لا يقتصر اختصاص البرلمان على سنّ القوانين والرقابة السياسية غالبا وإنَّما يتعدّى هذين الاختصاصين إلى اختصاصه في المساءلة الجزائية لأعضاء السلطة التنفيذية، وقد نشأ هذا الاختصاص ونمى في بريطانيا بلد النظام البرلماني، ثُمَّ انتقل مِنْها إلى دول أخرى عديدة، وهذا البحث ينصبّ على نشأته وكيفية تطوّره في بلده الأمّ بريطانيا، ثُمَّ يبحث نشأته وتطوّره في العراق، ويبحثه في الدساتير العراقية التي انشات برلمانا ومنحته هذا الاختصاص، وسنُلاحظ أنَّه لم يلتزم بقواعد المساءلة الجزائية هذه ويمنح الاختصاص فيها سوى دستوري (1925) و(2005) مع الاختلاف في تنظيمها على تفصيل يأتي خلال البحث.
