التعويض عن الضرر البيئي

Abstract

يقوم مفهوم التعويض على مبد أزاله الضرر البيئي الذي مس الآخرين , فذا تحقق الضرر البيئي ثبت حق المضرور في التعويض عنه, وان الهدف من التعويض في مجال الاضرار البيئية ليس جبر الضرر من طريق التعويض  فحسب وانما هو الحد من الانتهاكات البيئية . فالضرر البيئي قد يصيب الاشخاص او ممتلكاتهم  ,كما انه قد يصيب البيئة ذاتها. ومهما يكن الامر فالتعويض هو الاثر الذي يترتب على تحقيق المسؤولية. والتعويض طبقا للقواعد العامة للمسؤولية المدنية هو نوعين فقد يكون عينا او نقدا, الا انه اعطي للقاضي السلطة التقديرية في تحديد طريقة التعويض تبعا لطبيعة الضرر و احوال القضية.
