احكام عزل الوكيل دراسة فقهية وقانونية مقارنة

Abstract

سادسا البحث الموسوم بـ(أحكــام عــزل الوكيـــل دراسة فقهية وقانونية مقارنة) للمدرس الدكتور صبحي العادلي، وقد اشتمل على مقدمة وثلاثة فصول، تناول في المقدمة الدافع وراء اختيار الموضوع، وهو حاجة الناس إليه في تعاملاتهم، وتناول في الفصل الأول (عزل الوكيل)، وقد توزّع على مبحثين، أولهما (عزل الموكل وكيله)، أمّا الثاني فهو (عزل الوكيل نفسه)، وتناول في الفصل الثاني (خروج الموكل أو الوكيل عن أهلية التصرف)، وقد توزّع على مبحثين، أولهما (الموت والجنون)، والثاني هو (نواقص الأهلية الأخرى)، وتناول الفصل الثالث (اعتزال الوكالة في القانون)، وقد توزّع على مبحثين، أولهما (فسخ الوكالة بالعزل)، أمّا الثاني فهو(انتهاء الوكالة بخروج الموكل أو الوكيل عن أهلية التصرف)، وقد ظهر للباحث من هذه الدراسة مدى تركيز الشريعة الإسلامية على الجانب الاخلاقي.
