مسألة اجتماع الأمر والنهي - دراسة أصولية عند الإمامية

Abstract

لا يخفى على الدارسين والمشتغلين بعلوم الشريعة اهمية علم الاصول ومكانته فهو يوضح الاسس التي تسير عليها عملية استنباط الاحكام الشرعية لاسيما انه يتميز بجانبين:

الاول منهما انه علم يرتبط بالحقائق العلمية فيكتسب الطابع النظري العقلي .

والاخر انه يربطه بالواقع العملي بكل ما فيه من جزئيات تحتاج لبيان احكامها مع مراعاة التحولات التي تطرأ عليها والمستجدات التي تحصل لها ومع هذا الارتباط صار الاصول علما متجدداً ذا طابع فكري  يستند اليه الفقه  في آلية  عمله.    

وهذا جعل علم الاصول عند من يقول بفتح باب الاجتهاد علما قابل لتجديد النظر فيه واعادة صياغة المباني وفق جذور اصيلة وربما هذا الامر جعل المتأخرين من علمائنا يرجعون في تحليل المسألة الى اسسها الفلسفية  لمعرفة واقعها ومن ثم  الحكم عليه . ولعل مسألة اجتماع الامر والنهي في محل واحد هي  إحدى تلك المسائل التي خاض التفلسف فيها المضمار بين ان  يكون العنوان داعيا الى تعدد المعنون وهو متعلق الحكم  لانه  الموجود الخارجي  فهو مركب تركيب انضمامي  وبين من  يرى ان  تعدد العنوان  لا يوجب تعدد المعنون  والموجود واحد حقيقةً والتركيب الحاصل فيه تركيب اتحادي  واذا كان الموجود واحداً استحال ان يجتمع فيه امر ونهي  ولكلا القولين ادلة  استعرضها البحث وما يترتب عليها من ثمرات علمية وعملية ، والحمد لله رب العالمين.
