المصلحة الكبرى والموقف الشرعي

Abstract

    إن محبة الحق والدفاع عنه من خلال الأمور القريبة من قلوب الناس وعقولهم بل والأقرب إلى دينهم ودنياهم كان السبب وراء إختيارهذا البحث- المصلحة الكبرى والموقف الشرعي - وما أحوج الناس الى بحوث تقرِّب بعيدهم وتؤالف بين أذواقهم وعواطفهم وآراءهم ومذاهبهم ،.وقد انفتح البحث هنا على ما به يكتمل موضوعيا حيث الرؤية القرآنية الفقهية وحيث السنة النبوية المباركة والحجة في قولها وفعلها وتقريرها ، وحيث العقل ومدركاته كذلك والإجماع واتفاق المسلمين  ؛ بل ولم يُحرَم البحث في هذه المسألة بالخصوص من وسائله الموضوعية التي أكسبته قوة في هذا المجال الى جانب قوته الأصلية في الإستدلال لما فيها من أحكام جعلتها قاعدة من القواعد العقلية والشرعية ، ولما فيها من تفصيلات جعلت البحث مرناً يدخل مع الكتاب المجيد فيجد ضالته ، ومع السنة و مساهمات العقل والإجماع طرّاً فيجد ضالته فيها أيضا ، ولهذا فإن مباحث البحث التي تناولناها هنا كانت  ثلاثة بغض النظر عما يقتضيه المنهج العلمي في البحث أولا  من صفحات وسطور مع الخلاصة والمقدمة والتمهيد وبعض تعريفات مفردات العنوان لغة واصطلاحا  ، فكان المبحث الأول في منشأ تقديم المصلحة الكبرى  ، والثاني في النص القرآني والمصلحة الكبرى ، والثالث في السنة النبوية والمصلحة الكبرى ، وفي المبحث الرابع في تقدير المصلحة الكبرى وأخيرا في الخاتمة ثم في النتائج وقد استعنّا بفضل الله تعالى بكتب الفريقين وعلاجاتهم وتحليلاتهم في فروع البحث وتطبيقاته , وكل ذلك كان عبر ما وقع أمامنا من مصادر ،  وقد انتهينا من البحث بما لعله يناسب الحجم المسموح به في النشر في المجلات الرصينة والمحكّمة . راجين ممَّن لهم تقييم هكذا أنشطة أن يكونوا أملا في تسديده وتكامله وهو يضع بين أيديهم الرؤية الفقهية في المصلحة الكبرى وعلاقة هذه المصلحة بالحكم الشرعي في مباحثها الثلاثة  وتفريعاتها.
