The legal truth, its concept and conditions (analytical study)

Abstract

The topic of research in the legitimate truth is one of the topics of the Principles of Islamic jurisprudence. The fundamentalists of the jurisprudence dealt with their research in the semantics of the words, which constitute an important part of the premises that involve in the path of deriving the legal ruling. Among the investigations is the subject of the legal truth.

They agreed on its possibility and differed in its occurrence. Some of them said that the Legitimate truth is proven, and some of them denied it, and some of them said in detail, and some of them stopped, and that is because the words used in the tongue of the Prophet (may God bless him and his family) without relying on a presumption. And the ones who says affirmatively they carries the legal meaning, and the others who says negative they carries the linguistic meaning, and that some of the jurisprudential sources are included in the subject matter of the dispute and some do not.
