Abstract

The issue of responsibility for error is an important topic; It entails rights and duties, whether the result is in positive law, or in Islamic law.

We conducted here this comparative study between positive law and Islamic law, with regard to the issue of error, in order for us to know the mechanism by which the responsibilities for the error are arranged, and on what basis the offender bears the consequences of his error? Which theories apply their utterance or concept to the course of the sinner

bearing the damages of his sinner?
