There is no doubt that the theory of right، with its parts and elements، is an important vocabulary in Islamic jurisprudence، as it is the basic reference for determining the personal rights of individuals and groups in Islamic society، and with the increase in population and the spread of cities، the need arose for a system that is compatible with the increase in population density in cities. Buildings and real estate divided into several floors، which necessitates the existence of common spaces، areas، walls and courtyards، which of course enter into the ownership of all individuals who own the building، so what are the limits of their use and disposal by one of the owners? Here lies the importance of the research as a study in a new jurisprudential topic.
The research problem is to find a jurisprudential and legal way to dispose of these common spaces between owners through the use of the analytical and comparative method as the most appropriate for such a study.
The research was organized into three main investigations، the first of which dealt with the theoretical framework of the concept of the right and its pillars، the second of which dealt with the meaning of common parts and spaces jurisprudentially and legally، then the third came to include the jurisprudential and legal Judgments of the right to dispose of common spaces and parts، then concluded the research with the most important results reached by the research with a list of the most important sources and references، and our last call is to praise God، Lord of the Worlds.
