The establishment of the state and its legal system depends on the constitution, whose rules are binding on all authorities and whose rules are distinguished by their supremacy and superiority over other laws in normal circumstances. Therefore, the modern state is based on the existence of a group of constitutional institutions that cooperate among themselves to achieve the state's goals and serve its highest interests, and is based in the traditional division of state powers on three main powers: the legislative power, the executive power, and the judicial power, based on the principle of separation of powers, and with the difference in the relationship between them according to the political system adopted in each state, that the legal system is achieved in the state through the constitutional legislation that embodies the principle of separation of powers and establishes the organic separation between them so that each authority is independent and equal in place, neither subordinate nor secondary while maintaining a degree of cooperation and coordination in the exercise of powers.
Constitutions often provide for mechanisms to deal with unusual extraordinary circumstances in order to prevent their damage with the least possible losses while maintaining the principle of legitimacy for the shortest possible period of time. One of the most important mechanisms for dealing with extraordinary circumstances is the suspension of work on certain constitutional and legal texts for a specified period or the temporary non-compliance with them until the end of those circumstances. The state of emergency and the activation of the exception systems by granting the executive authority broad powers to confront the crises that hinder the application of the principle of regular legality, document procedures and conditions, therefore legality is considered the cornerstone in guaranteeing the rights and freedoms of citizens in aspects of social, economic and political life, as the governing bodies can only impose restrictions on these freedoms by adhering to the applicable legal rules.
