الواقع وآثاره في الاحكام الشرعية - فقه الجهاد أنموذجا

Abstract

إن المصادر الحضارية التي تشكل قناعات العقل المعرفي الإسلامي ثلاثة، هي:

أولاً: النص الديني- وهو عبارة عن: (القرآن الكريم ، والسنة النبوية وسنة أهل البيت، ومأثور الصحابة والتابعين).

ثانياً: الممارسة أو التجربة العملية : وهي مكونة من عصر الخلافة الأولى (40هـ)، والعصر الأموي (132هـ) ، والعصر العباسي (656هـ) ، والدولة العثمانية (1924م).

ثالثاً : الفكر الديني : وهو عبارة عن تفاسير للنص القرآني ، وشروح للحديث

وسيتضح ومن خلال بعض الشواهد والأمثلة أهمية ودور الواقع في أمرين ، الأول : فهم النص. والثاني : ضبط الفتوى وعلاقتها بالزمان والمكان

وللحديث عن الواقع وأهمية قراءته في حل وتفهم كثير من الأمور والأحكام الفقهية ، نجعل البحث بالمطالب الآتية:

المبحث الأول : مفهوم الواقع وأهميته .

المبحث الثاني: الواقع ونظرية تأثير الزمان والمكان في الأحكام الشرعية .

ومما خلص له الباحث ان استحضار الفقيه للواقع في نسقه الزماني والمكاني، سيمنحه أبعاد أعمق في تحقيق الموقف الفقهي، وان نظرية الزمان والمكان وتغيّر الموضوعات ستساعد الفقيه على الخروج في بحثه عن فضاء النص وموضوعاته إلى فضاء الواقع الاجتماعي.
